TERMS AND CONDITIONS
The following are terms and conditions for the sale of goods that will govern any contract for sale that we (Dartmoor Cycles) enter into with you. Please read these terms and conditions carefully.
These Terms and Conditions tell you the rights and obligations you have. Please read these carefully. You may have other rights granted by law and these Terms and Conditions do not affect these.
This does not affect your statutory rights as a consumer.

Purchasing From Us
To purchase online from us you must be over 18.
By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes without asking for your consent and you may ask that your details are removed from our system by writing to the address above.
We are not obliged to supply the goods to you until we have confirmed acceptance of your order and this is when the contract is made. You do not own the goods until we receive payment in full.
Our prices include VAT - VAT No. 125323643. Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.
All prices and offers are subject to change and availability. Web based prices are given on the assumption that no variation in the price will be made by the manufacturer/sole importer and that Government levies remain unaltered. In the event of such changes, orders placed before the variation will remain the same price and no further increases will be passed to customer.
All website and mail orer payments are taken in full at the point of purchase regardless of stock. Our acceptance of an order takes place when we dispatch the order, we will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made, unless we have notified you that we do not accept your order or you have cancelled your order.
We endeavour to ensure that all pricing information on the DartmoorCycles.co.uk website, our other online stores and any subsequent digital or printed publications are correct. Occasionally, however, an error may occur and products may be priced incorrectly. If a product's correct price is lower than the price stated on the online store, we will charge the lower amount and send you the product. If a product's correct price is higher than the price stated on the online store, we will, at our discretion, contact you and ask you whether you wish to proceed with the order at the correct price or cancel your order and notify you of such cancellation. We will not be obliged to supply products at an incorrect price.
For out of stock items, delivery dates given are only estimates.
PayPal Payments
Customers making payments through PayPal must have a confirmed address associated with their account. We reserve the right to withhold dispatching any orders where the PayPal account is not confirmed.
Delivery
We aim to dispatch goods to you within 2-5 working days but we cannot give an exact delivery date. We also may deliver the goods in several consignments but will not charge any extra delivery for this. We don't take payment until we are ready to despatch your good.
Complaints
We try very hard to exceed our customer expectations. In case we fail and you need to complain about our service then please email us at sales@dartmoorcycles.co.uk
We will acknowledge all questions or queries within a maximum period of 48 hours.
Damaged or Defective Goods
We will supply goods that are free from defects in materials and workmanship for a period of 12 months (or longer if required by law) from the date of delivery.
You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us within 24 hours of delivery and we will arrange for their return to us or the manufacturer at no cost to you. If the goods are found to be damaged prior to delivery to you, or defective, we will at your option repair or replace the goods or refund the price paid by you.
Warranty Returns
Should your product develop a fault whilst still under warranty, we will endeavour to sort it for you. However, the postage costs to return the product to us will be at your expense.
Please contact us before returning warranty items as some can be sent to the manufacturer direct to speed up turnaround times. Items maybe required to be returned to the UK importer/manufacturer to be assessed in order to ascertain if the fault is within the offered warranty terms.
Items Lost In The Post
In the rare event that Royal Mail or couriers loose your parcel for delivery, we are not able to process a claim for the parcel until 14 working days have passed from the time of us sending the goods. Once the 14 days have passed we will process a claim as quickly as possible, however please note the claims process can take several weeks. We do not wait for the compensation to come to us before we refund you or resend the goods, but we do have to wait for confirmation that the claim has been accepted.
Please understand that in this situation it is not us who have lost the goods and it is as frustrating for us as it is for you.
Returns
Our returns policy is simple if you aren't happy with your purchase please return it in an unused re-sellable condition (including any packaging and manufacturers labels) to us within 14 days of receipt and we will give you a full refund or an exchange credit as required, excluding any postage costs (where an item has been sent to you with free shipping there will be a £3-£5 fee to cover costs). The costs of returning goods to us shall be borne by you.
Items returned outside of the 14-day period or without labels as above may be subject to a restocking fee.
If you return any shoes or clothing to us for a size exchange then the return postage back to you will depend on Royal Mail or our preferred courier’s fees at the time. At our discretion, some items will be subject to posting by Royal Mail Special Delivery.
When returning any item to us for whatever reason it is your responsibility until the goods have been delivered to us. We cannot be held responsible for items sent back to us but lost in transit.
If you are returning an item due to an error by us, we will cover the cost to return the item up to first class recorded level. Please make a note on the returns form that you would like the postage cost refunded and of course there will be no cost to send out the correct item. If you are returning a larger item due to our mistake, please contact us first as we might be able to get our couriers to collect the item.
If you return a bike for any reason you will have to arrange the return yourself and will be liable for any damage in transit on the return journey.
If you are returning anything to us we can only accept it with a fully completed returns form.
Guarantees
All guarantees for products are provided entirely by the manufacturers/UK importers and are subject to terms contained therein. Purchasers are reminded to complete all warranty cards/documents upon receipt of goods where appropriate.

While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. Limitations Upon Liability
Advice given by agents or servants of this company during telephone/internet orders is based entirely upon information given by the purchaser. Where advice is given after visual inspection by agents or servants of this company, such advice shall amount to an opinion only and Dartmoor Cycles shall not accept liability for any inaccuracies. Additionally, goods supplied are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put.
No liability for failure can be accepted by Dartmoor Cycles for such alternative use, amendment or modification.
Compatibility of goods is not guaranteed where modifications or alterations have been made and the company shall, in such circumstances and at its discretion only, issue a refund or credit to the purchaser.
Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The purchaser further confirms that it shall be reasonable for the seller to inspect, repair or replace (at its option) such defective goods and allow manufacturers to undertake inspections so as to allow production methods to be modified. The purchaser also accepts that it is reasonable to inform the seller of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow the seller to remedy the defect, failure or interruption. Parts modified or adapted by the purchaser shall no longer be warranted by the manufacturer nor shall the company be liable for any failures resulting subsequent to modification.
"Competition" goods are supplied for specialist use and are subject to extreme wear and stress whilst in use. Life expectancy and durability are greatly reduced and purchasers should note that any claim for failure/wear shall be limited to that of the manufactures guarantees. It is agreed that such use shall be a relevant circumstance for the Sale of Goods Act 1979 (as amended). In addition, parts connected to parts supplied by this company may be placed under stress where specialist/competition parts are used, and purchasers should take advice from experts prior to purchase. Manufacturers may also limit guarantees when components are installed for competition use.
Where modifications or alterations and poor maintenance to goods have been made Dartmoor Cycles shall accept no liability for death or personal injury unless caused directly by its own negligence.
No liability is accepted by the company where purchasers attempt to modify or install components supplied where it is known or ought reasonably to be known that the part supplied is incorrectly supplied, defective or otherwise not in accordance with the order.
Dartmoor Cycles accepts no liability in respect of failure to supply or other interruptions caused by matters beyond the reasonable control of the company, including strikes, lockouts, civil disputes, acts of God, war or actions by third parties.
Notwithstanding any other provisions of this Agreement, nothing in this Agreement shall confer, nor is it intended to confer, a benefit on any third party (for the purposes of the Contract (Rights of Third Parties) Act 1999 or for any other purpose).
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
PRIVACY POLICY
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service.
If we send you an email in the future, we will give you the chance to refuse any further marketing email from us or from another trader in the future.
We do not send random marketing emails to personal email addresses (spam).
The type of information we will collect about you includes: your name, address, phone number, e-mail address, your credit card details.
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. We are entitled by law to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you. If you find any inaccuracies we will delete or correct it promptly.
If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
